Hology Engine Terms of Service
By accessing or using Hology Engine ("the Application"), you agree to comply with and be bound by the following terms and conditions. If you do not agree to these terms, do not use the Application.
You must be at least 18 years of age to access and use any parts of the service. if you are above the age of 13, but below the legal age majority, this service may only be used with the consent and supervision of a parent or legal guardian.
1. Acceptance of Terms
1.1 By using Hology Engine, you agree to these Terms of Service and any additional terms that may be provided within the Application.
2. License
2.1 Hology Interactive AB grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Application solely for the purpose of developing and distributing your own interactive content.
2.2 This license does not grant you any right to access, use, or exploit the underlying source code, architecture, systems, design, or technical implementation of the Application except as strictly necessary for its intended use.
2.3 You may not use the Application to develop, directly or indirectly, any product, service, or technology that competes with Hology Engine or replicates its core functionality, features, or user experience.
3. User Content
3.1 You are solely responsible for any content you create or upload using Hology Engine.
4. Prohibited Conduct
4.1 You agree not to engage in any conduct that may violate these Terms of Service or the law.
4.2 Prohibited conduct includes, but is not limited to, the following:
- Violating any laws or regulations
- Attempting to interfere with the proper functioning of the Application
- Uploading malicious code or malware
- Harassing or abusing other users
- Allow others to use the Application with your account information
- Provide, utilize, or allow others to employ or gain entry to the Products and Programs in any of the following contexts: as part of a computer service enterprise, an external contracting operation, a membership or subscription model, a service bureau arrangement, a time-sharing setup, within a hosted service environment, or for the benefit of any external party.
- Using the Application to analyze, replicate, or emulate its functionality, workflows, or design for the purpose of creating a similar or competing product
5. Intellectual Property
5.1 Hology Engine, including but not limited to its software, source code, object code, architecture, systems, tools, workflows, user interface, design patterns, algorithms, and all related intellectual property rights, are and shall remain the exclusive property of Hology Interactive AB.
5.2 Restrictions
You agree that you will not, directly or indirectly:
(a) Copy, reproduce, distribute, or publicly display any part of the Application except as explicitly permitted;
(b) Reverse engineer, decompile, disassemble, decode, or otherwise attempt to derive or access the source code, underlying ideas, algorithms, structure, or organization of the Application;
(c) Analyze, benchmark, or inspect the Application for the purpose of replicating its functionality, architecture, or user experience in a competing product;
(d) Create derivative works based on the Application or any part thereof;
(e) Use the Application, or any output or observations derived from it, to develop or train any competing engine, framework, or development tool;
(f) Circumvent, disable, or interfere with any security, licensing, or technical protection measures.
5.3 No Competitive Use
You may not use the Application to develop, support, or assist in the creation of any software, service, or platform that is competitive with Hology Engine.
5.4 User Content
You retain ownership of content you create using Hology Engine. However, this does not grant you any ownership rights to the Application itself or any of its underlying technology.
5.5 Feedback
If you provide feedback, suggestions, or ideas, you grant Hology Interactive AB a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate such feedback without restriction.
6. Disclaimer of Warranty
6.1 Hology Engine provides the Application "as is" and "as available" without any warranties of any kind.
7. Limitation of Liability
7.1 Hology Interactive AB shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the Application.
8. Your Account
8.1 As a Personal User or Business User, you are in charge of everything that happens via your account, even if it wasn't done by you or wasn't done with your knowledge or approval. You are not permitted to (A) use someone else's account or (B) disclose your account information, whether on purpose or accidentally, with anyone other than an authorized account administrator. Your account information may be used by your account administrator to control how you use and get access to the Application.
9. Third-Party Services and Software
9.1 Hology Interactive may make third-party software and services (including plug-ins and extensions) available to you through the Application. Third-party software and services are not the Application as defined in the Terms and your acquisition and use of such third-party software and services is solely between you and the third party. You are responsible for complying with all applicable third-party terms.
10. Termination
10.1 Termination by You
You have the right to end your subscription and discontinue your use of the Products and Programs at any moment. However, canceling or terminating your account does not exempt you from any responsibility to settle any unpaid fees related to your subscription, which may include, but are not limited to, early cancellation charges.
10.2 Termination by Us
Except where specified in the Product-Specific Conditions, we reserve the right to instantly cease or pause your ability to utilize and enter the Products and Programs if Hology Interactive determines, at its sole discretion, that:
(A) You violate any clause of the Conditions (or behave in a way that clearly indicates your unwillingness or inability to adhere to the Conditions);
(B) You neglect to pay fees for the Products and Programs in a timely manner, if applicable;
(C) You engage in physical, verbal, or other forms of abuse, intimidation, bullying, or harassment towards us or our staff (in such cases, we may alternatively limit or restrict your access to the Products and Programs);
(D) You persistently file complaints without good faith or reasonable grounds, and persist in doing so after we've requested you to stop (in such instances, we may alternatively limit or restrict your access to the Products or Programs);
(E) Continuing to offer the Programs or Products to you would result in a violation of any relevant laws;
(F) We choose to discontinue the Products and Programs, either partially or entirely, if maintaining services in your region becomes infeasible due to legal changes or other factors.
10.3 Account Deactivations and Appeals
If you believe your Hology Interactive Account has been deactivated in error, you may submit an appeal to: hello@hology.app
10. Changes to Terms
10.1 Hology Interactive AB reserves the right to update or modify these Terms of Service for new versions of the Application at any time without prior notice.
10.2 For users who have downloaded a specific version of the Application, the terms applicable at the time of download will continue to govern their use of that version.
10.3 It is your responsibility to regularly check for updates to the Terms of Service for the latest version of the Application. Continued use of the updated Application constitutes acceptance of the new terms.
11. PRICE AND PAYMENT
11.1 The website shows the current prices for the Services, which may be updated from time to time. Price changes do not affect purchases already made.
11.2 Payment for the Services is made via Stripe, Inc in advance unless otherwise specified. We take payment when you complete your purchase.
11.3 The payment service is provided by Stripe, Inc. Stripe's privacy policy can be found here https://stripe.com/ende/legal/privacy-center. The payment options available are shown when you connect to the payment service.
11.4 Depending on the payment option chosen, additional charges may apply as set out in the terms and conditions of the payment option.
11.5 Pricing model changes
Hology Interactive AB may introduce, modify, or discontinue pricing models (including the free version), plans, packages, and billing metrics at any time. Unless expressly stated otherwise, pricing changes apply to new purchases and to renewals that occur after the effective date of the change.
11.6 Notice for renewals
If you are on a renewing paid plan, we will provide reasonable advance notice of any pricing changes that will apply to your next renewal term. If you do not agree to the updated pricing, you may cancel before the renewal date, and you may continue to use any Legacy Version available to you through the end of your then-current paid term.
12. Dispute Resolution, Arbitration Agreement
12.1 Notice of Claim and Required Information Dispute Resolution Process
If you have any concern or dispute that Hology Interactive Customer Care is unable to resolve (Claim), you agree to first try to resolve the dispute informally and in good faith by contacting Hology Interactive AB. The Notice of Claim must provide Hology Interactive with fair notice of your identity, a description of the nature and basis of your Claim, and the relief you are seeking, including the specific amount of any monetary relief you are seeking, and cannot be combined with a Notice of Claim for other individuals. If any dispute related to your Claim is not resolved within 60 days of receipt, any resulting legal actions must be resolved through either small claims court or final and binding arbitration, including any dispute about whether arbitration is required for the dispute, subject to the exceptions set forth below. Neither party shall initiate legal action until 60 days after the Notice of Claim is received. This agreement to arbitrate shall apply, without limitation, to all claims that arose or were asserted before the effective date of the Terms. The arbitrator, and not any federal, state, or local court or agency, shall have the exclusive authority to resolve any dispute relating to the interpretation, applicability or enforceability of the Terms or formation of the Terms, including whether any dispute between us is subject to arbitration (i.e., the arbitrator will decide the arbitrability of any dispute) and whether all or any part of these Terms are void or voidable. Claims related to the Terms, Services, or Software are permanently barred if not brought within one year of the event resulting in the Claim.
12.2 Disputes
If there is any dispute about or involving the Company and/or the Service, you agree that any dispute shall be governed by the laws of Sweden, without regard to conflict of law provisions. You agree to personal and exclusive jurisdiction by and venue in the courts of Sweden.
You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of the service or these TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred.
13. Anti-Abuse & Enforcement
13.1 Hology Interactive AB reserves the right to investigate suspected violations of these Terms, including unauthorized use, reverse engineering, or competitive misuse.
13.2 Violations may result in suspension or termination of access, as well as legal action.
13.3 You agree that any breach of Sections 2 or 5 may cause irreparable harm to Hology Interactive AB, and that injunctive relief may be sought in addition to other remedies.
